The method

The day-rate math, done the legal way

Under the FLSA day-rate rule (29 CFR §778.112), a day rate covers all hours at straight time — so overtime is owed as a half-time premium on the regular rate, not time-and-a-half on top.

  1. Count day credits

    A worked day of 5+ hours earns a full day; a shorter day earns a half. Thresholds are yours to configure, with per-day overrides.

  2. Fix the promise

    Total pay = days × the promised day rate. That handshake number never moves — no matter how the hours land.

  3. Back-solve the bonus

    DayTally splits pay into reported day-rate wages plus a bonus, sized so wages + bonus + overtime premium equals the promise exactly.

  4. Pay the premium

    The regular rate is recomputed from actual hours each week, and hours over 40 earn the additional half-time — fully documented on the entry sheet.

Fair questions

Is the day-rate method actually legal?

Yes — it's spelled out in federal regulation. 29 CFR §778.112 covers employees paid a flat sum per day: the regular rate is total pay divided by total hours, and overtime is owed as an extra half-time on hours over 40. DayTally applies that arithmetic and documents every step on the entry sheet. That said, DayTally is a calculation tool, not legal advice — review your setup with your advisors.

What about state overtime laws?

DayTally computes the federal FLSA method today. Some states (California most famously) impose daily overtime and other rules that differ. State-specific calculation modes are on our roadmap as a premium feature — until then, check applicability with counsel in your state.

Why does the "bonus" change every week?

Because it's back-solved. Your crew was promised days × day rate. As overtime hours grow, the OT premium grows — so the bonus shrinks by exactly that amount, keeping the total on the promise while wages, bonus, and premium each stay properly reported.

Does DayTally replace my payroll provider?

No — and that's the point. DayTally is the pre-payroll calculation layer. It produces the numbers (days, wages, bonus, reg/OT hours, rates) that you key or import into ADP, Gusto, QuickBooks, Paychex, or whatever already cuts your checks.

Where does the time data come from?

Anywhere. Paste the text report from your punch-clock software, upload a CSV export with a quick column mapping, or type hours into the weekly grid from paper cards. Direct time-clock API integrations are on the roadmap.

How do you know the math is right?

DayTally's engine was rebuilt from a real company's production payroll workbook and is verified against 1,296 actual employee-weeks from it — every bonus, rate, premium, and total matches to the penny, and that test suite runs on every change we ship.
