Terms of Service

These terms govern your use of DayTally, the payroll calculation service at daytallyhq.com and app.daytallyhq.com. By creating an account you agree to them.

1. The service & fees

DayTally computes payroll figures — day credits, wages, bonuses, regular rates, and overtime premiums — from the rates and hours you provide, and produces reports you can use with your payroll system.

New companies receive a 7-day free trial (no card required). Continued use requires a paid subscription, billed monthly or annually through Stripe, tiered by active employee count as shown on our pricing page. Founders-priced annual subscriptions keep their discounted rate for as long as the subscription renews without interruption. We may change prices for new billing periods with at least 30 days' notice; grandfathered founders pricing is honored per the preceding sentence. Fees are non-refundable except where required by law.

2. Not legal, tax, or accounting advice

DayTally is a calculation tool. It implements the federal FLSA day-rate methodology (29 CFR §778.112) and related federal arithmetic, but it does not know your facts, your contracts, or your state's wage-and-hour laws. You are responsible for verifying that the methodology applies to your situation and for the accuracy of the data you enter. Consult qualified legal, tax, and accounting professionals before relying on any calculation.

Don't attempt to break, probe, or overload the service; don't use it to violate the law; don't resell it without our written agreement.

5. Your data

Your workspace data is yours. You grant us the limited rights needed to host and process it to provide the service, as described in the Privacy Policy. You can export your calculations at any time (CSV, print).

6. Availability & changes

We aim for high availability but the service is provided "as is" without uptime guarantees, especially during early access. Features may change; we won't materially reduce core functionality without notice.

7. Limitation of liability

To the maximum extent permitted by law, DayTally and its operators are not liable for indirect, incidental, or consequential damages — including wage claims, penalties, or tax assessments arising from use of the calculations. Our total liability is limited to the amount you paid us in the 12 months before the claim (or $100 if you paid nothing).

8. Termination

You can stop using DayTally and request deletion at any time. We may suspend accounts that violate these terms, with notice where practicable.
